AUCTION END TIMES: Comas Montgomery Realty & Auction Co., Inc. Online Auctions are timed events and all bidding will close at specified time. Comas Montgomery Realty & Auction Co., Inc. Online Auctions also have an auto extend feature. Any bid placed in the final 5 minutes of an auction, the auction ending will be automatically extended 5 minutes from the time the bid was placed. Example: if an auction scheduled to close at 6:00 receives a bid at 5:59, the close time will automatically extend 6:04. The auto extends feature remains active until no further bids are received within a 5 minute time frame.

MAX BIDS: When you place a max bid, the bidding will take you to your max bid if it is under the undisclosed reserve. EXAMPLE: If an auction has an undisclosed reserve of $100,000 and the current bid showing is $25,000 and you put your max bid in as $80,000 but you only want it to go to $26,000 the system will take your bid to $80,000 because the system knows the reserve has not been met and there is no need in placing a bid that that hasn’t met he reserve.

IF RESERVE IS NOT MET: The seller reserves the right to accept the final bid even if it does not meet or exceed the undisclosed reserve.

BUYER’S PREMIUM: There will be a buyer’s premium of 10% added to the bid price to arrive at final purchase price. Example: Bid Price $1,000,000 plus $100,000 (10% Buyer’s Premium) equals Contract Purchase Price of $1,100,000.

BIDDER APPROVAL: In order to bid on this property, $50,000 is required to be deposited with Comas Montgomery Realty & Auction Co., Inc. BY MONDAY NOVEMBER 22, 2010. If you are the successful bidder the $50,000 will be used as part of the 10% earnest money requirement. If you are not the successful bidder the $50,000 will be returned to you within 72 hours of the close of bidding for the auction. NOTE: If you are the successful bidder the $50,000 IS NON REFUNDABLE.

AUCTION BIDDER DEFAULT: Successful bidder not executing and returning
the contract with earnest money deposit within 72 hours of the close of bidding for the auction will be considered in default. The $50,000 deposit will be NON FUNDABLE. Additional default remedies are reserved by Comas Montgomery Realty & Auction Co., Inc. and the Seller as provided in the Auction Terms and Conditions and the Contract for Sale of Real Estate. Comas Montgomery Realty & Auction Co., Inc. reserves the right to sell to the second-highest bidder in the event the successful high bidder does not comply with the terms of the sale.

Any dispute between Comas Montgomery Realty & Auction Co., Inc., its Agents or
Representatives and the Buyer(s) or Bidder and or the Seller will be tried in a court of jurisdiction in Williamson County, Tennessee. By bidding on the property, buyer agrees to all terms and conditions set forth. The contract is required to be fully and correctly completed, without any modifications and properly signed. A contract that is incomplete, incorrect, or modified in any respect, is considered to be in default.

Acceptance of Bid Prices: Successful bidder(s) will be required to enter into a purchase agreement immediately following the close of the auction.
